In Florida, the laws governing a referral service for rental property? Flat fee only?
I am interested in starting a reference service in Florida who directs people to vacation and annual rental fee for a search engine to charge the owner of the property. It will be the management properties, simply send a tenant.I know that there are several laws involving real estate commissions and being licensed as an agent or realtor, but I am not and can not find the local response to date. This state seems to be even more strict about the proper licensing and commissions, I want to make sure I manage the configuration of appropriately.Any advice would certainly help! I hope the voice of experience in the answers! Thanks!
Take Care and obtain professional advice. For short-term rentals would be nice to think, but if you are offering a service that could be classified as A list of rental then the penalties for getting it wrong are enormous. "The rental companies or anyone who announces the rental property information or lists of any so is acting as an agent or broker and is subject to the laws regulating licensed occupations "(Florida Real Estate Principles, practices and Law – Crawford). Florida Statute 475 covers this in its entirety and is available at www.myflorida.com. His first degree misdemeanor and the maximum penalty for this is a fine of $ 1000 and / or imprisonment up to one year! Of course, if you are doing this without a license, all penalties for which are also implemented. In practical terms, there hundreds of sites that offer this service for very little money, and thousands of individual sites that offer vacation rentals – Are you sure this is a good idea in a competitive business? Do not pour water on the fire, but I look very carefully at their business model and wish him every success.
